365 Teeth Whitening its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Governing Law

Law and jurisdiction of these terms and conditions will be governed by and construed in accordance with applicable United Kingdom law, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of the United Kingdom. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a United Kingdom court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Entire Agreement

These terms and conditions constitute the entire agreement between you and us in regard to your use of our website, and supersede all prior agreements in respect of your use of this website.

1. You will have a consultation with your dentist before using any products on 365teethwhitening.co.uk who will advise you what product is suitable for you.

2. You must be over 18 years of age to purchase and to use any products from 365teethwhitening.co.uk, unless approved by your dentist.

3. You have read and fully understand the How to use whitening strips or gel sections.

4. If we do not have your item in stock an equal or like for like item of greater value may be dispatched.

5.  If you experience any problems with any product you will immediately stop and consult your dentist/doctor.

6. If you are pregnant always consult your Dentist and Doctor before using any products from 365teethwhitening.co.uk

7. All none called for, failed to collect, incomplete address returns will be subject to postal charges and 15% admins fees (total orders) resulting in full cost or processing orders.

8. Only use the products for the sole purpose of what they are intended for.

9. We will not accept any returns for used/opened syringes, opened pouches, used mouth guards or open toothpastes. If any seals or retail packaging is opened we will not under any circumstances accept your return for dental hygiene reasons.

10. You are entering into an agreement with 365 Teeth Whitening and none of our 3rd parties or outsourced partners.

11. All documents for claims for denial of receipt (DOR) MUST be received within 15 days of the dispatched date.

12. You will not use if you have any loose or decayed teeth.

13. Only use custom made mouth formed mouth guards by a Dentist of Dental Lab

14. Will not use if you have loose crowns, bridgework, fixed orthodontic treatment or any other oral problems e.g. gum disease.

15. You will not use if allergic to Carbamide Peroxide, Glycerin, Carbome Flavour, Hydrogen Peroxide, Ammonium, Hydroxide and Silicone.

16. You will not use any whitening product over 0.1% from 365teethwhitening.co.uk unless you are a lawful/qualified dentist. Any products purchased which are greater than 6% Hydrogen Peroxide or 16% Carbamide Peroxide can only be used for research purposes and not dental/cosmetic use.

17. You have read and understood our Shipping & Returns policy which outlines all shipping fees and delivery times.

18. You agree that all warranties and returns outside of our normal terms and conditions are the sole discretion of 365 Teeth Whitening. You agree you have read and fully understand our delivery and returns policy and that liability is limited to the amount paid for.

Our Liability

365 Teeth Whitening cannot be held liable for any damage to persons, property or any intangible damage alleged to be the result of defective performance or incorrect use of the products sold by 365 Teeth Whitening. We accept no liability whatsoever for damage of any nature whatsoever caused by this website and/or decisions based on information from the website. 365 Teeth Whitening is not liable for any inaccuracy or delay in passing on delivery details and notifications using the internet or any other communication tool, as between the buyer and 365 Teeth Whitening, or between 365 Teeth Whitening and third parties, in so far as it concerns the relationship between the buyer and 365 Teeth Whitening.

All of the information on the Website is by its nature generic. All patients are different and their dental problems are therefore also different. If you have any dental problem or query we strongly recommend that you speak to a qualified dentist/orthodontist. You should not place any specific reliance on any generic advice displayed on this Website. 365 Teeth Whitening makes no warranty or representation that any of the information on the Website is accurate, complete or current or that it contains no technical or typographical errors.

365 Teeth Whitening excludes all liability for the content on the Website, however arising and of whatever nature (whether direct or indirect or consequential) to the fullest extent permitted by law. 365 Teeth Whitening does not guarantee continuous, uninterrupted or secure access to the Website. The operation of the Website may be affected by numerous factors outside 365 Teeth Whitening control. 365 Teeth Whitening accepts no liability for any losses of whatever nature you may incur as a result of any aspect of the Website being unavailable for use or not operating in the way you would expect. Nothing in the Terms of Use shall be construed as seeking to exclude or limit liability of 365 Teeth Whitening for death or personal injury caused by its negligence.

Whilst 365 Teeth Whitening makes all reasonable attempts to exclude viruses and other malicious code from the Website, 365 Teeth Whitening accepts no liability for viruses or damage caused by viruses or the like and strongly recommends that you maintain appropriate virus screening software in place at all times.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Delivery & Returns

By accepting our terms and conditions you agree to our shipping policy which can be found here, our returns policy which can be found here and our cancellations policy which can be found here. You also agree our couriers can leave your order in a safe place on your property if no one is available to accept the parcel even though all our deliveries require a signature. 365 Teeth Whitening will not be held liable we will not be held responsible for any courier delays, non-deliveries, courier compensation claims or any issue related to delivery of your order, regardless of what the courier policy specifies.
